Terms of Service
1. Scope
These Terms are a supplement to the free software licence that governs each asset (see §2). They cover support, trademarks, and the marketplace relationship. Where these Terms conflict with the applicable GPL licence, the GPL prevails and the conflicting provision here is void.

2. Your rights under the GPL
Each Asset is free software. You may use, study, modify, and redistribute it — including commercially — under the terms of the GNU General Public License as published by the Free Software Foundation, at the version stated above or, at your option, any later version. The full licence text ships with each Asset and is reproduced in LICENSE at the root of the source repository.
Nothing in these Terms restricts the rights the GPL grants you. In particular, you may:
- install the Asset in any number of portals, yours or your clients';
- modify it however you wish; and
- redistribute original or modified copies, provided you comply with the GPL — which requires that you pass on the same freedoms, retain copyright and licence notices, state significant changes, and make corresponding source available to your recipients.
3. Licence version, and the theme in the source repository
Both Assets are original works. They do not incorporate code from the HubSpot CMS Theme Boilerplate, so they are offered under GPL-2.0-or-later — you may use them under GPLv2, or under any later version at your option.
For completeness: the source repository also contains a CMS theme derived from the HubSpot CMS Theme Boilerplate, which is licensed Apache-2.0 (Copyright 2020 HubSpot, Inc.). Apache-2.0 is compatible with GPLv3 but not GPLv2, so that theme carries GPL-3.0-or-later. The theme is not offered on the HubSpot Asset Marketplace and is not covered by these Terms. Where the Assets are bundled into it, the "or later" option conveys them under GPLv3.
4. Media and third-party assets
We warrant that all images, icons, fonts, audio, and video distributed inside an Asset are either original, or licensed for redistribution as part of a HubSpot Asset Marketplace listing. HubSpot removes listings containing media not licensed for distribution; if you believe an Asset contains improperly licensed media, contact daljo628@gmail.com and we will remedy or remove it.
Bundled third-party components remain under their own licences, which are documented alongside them.
Both Assets are composed entirely of original HubL, CSS, and JavaScript, plus an SVG icon each. Neither bundles third-party fonts, stock imagery, audio, or video.
5. Trademarks
The GPL licenses copyright, not trademarks. Our names, logos, and branding are not licensed to you. If you redistribute a modified copy, you must not present it as our product or use our branding to promote it. You must likewise follow HubSpot's Branding and Trademark Usage guidelines; "HubSpot" is HubSpot, Inc.'s trademark, not ours.
6. Support
Support is a service we offer alongside the software; it is not a condition of the licence, and using your GPL rights never forfeits it.
Where support is offered, it covers defects in the Asset as we distribute it: rendering faults, field configuration errors, and incompatibility with supported HubSpot features. Requests go to daljo628@gmail.com and are handled on a reasonable-efforts basis. We do not commit to a specific response time, and support is provided at our discretion and without charge.
Support excludes custom development, third-party integrations, modified copies of the Asset, and defects originating in the HubSpot platform.
7. Updates and resubmission
We may release updates to fix defects, maintain HubSpot compatibility, or add functionality, delivered through the marketplace update mechanism.
HubSpot requires any change to a listed theme or module to be resubmitted for approval before it reaches you, so fixes may be delayed by HubSpot's review queue — outside our control. We are not obliged to release updates, and an update may overwrite modifications you made to your installed copy.
8. Fees and refunds
The Assets are currently distributed free of charge. No fee is payable to us, and no refund is applicable.
HubSpot does not permit a published listing's price to change between free and paid in either direction. Any future paid product would be a separate listing under its own terms; nothing here converts a free Asset you have already installed into a paid one. Note also that GPL-licensed software may be lawfully redistributed by its recipients, including for free — price a future paid listing with that in mind.
The following would apply only to such a paid listing:
- Billing is administered by HubSpot via PayPal or Stripe. HubSpot is not responsible for gateway issues, and an Asset may be temporarily delisted if a provider payment method fails.
- Refund policy: refunds available within 7 days of purchase.
- On refund, HubSpot removes the Asset and any dependencies it installed from your account; you are responsible for resulting breakage on pages that relied on it.
9. Warranty disclaimer
As stated in the GPL: the Asset is provided without any warranty, to the extent permitted by applicable law. There is no warranty of merchantability, fitness for a particular purpose, title, or non-infringement, and no guarantee that the Asset is uninterrupted, error-free, or fit for your requirements. The entire risk as to quality and performance is with you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND CONSISTENT WITH THE GPL'S OWN LIMITATION OF LIABILITY, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE ASSETS. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU ACTUALLY PAID US FOR THE ASSET IN THE TWELVE MONTHS PRECEDING THE CLAIM. FOR ASSETS DISTRIBUTED FREE OF CHARGE, THAT AMOUNT IS ZERO.
Some jurisdictions do not allow these exclusions, so parts of §9 and §10 may not apply to you.
11. Marketplace terms and acceptable use
Your installation is also governed by HubSpot's own terms, which we cannot override:

- HubSpot Acceptable Use Policy
- HubSpot's Branding, Trademark Usage, and Content Usage guidelines
HubSpot is not a party to these Terms but administers distribution and may remove a listing that violates its policies.
We do not use an Asset to track visitors without informed, explicit opt-in consent (see our Privacy Policy). Tracking added by you in a modified copy is your responsibility.
12. Termination
Your licence is the GPL, and it terminates only as the GPL provides — that is, on your violation of the GPL itself, with the reinstatement provisions of GPLv3 §8 where applicable. We cannot revoke it because you stopped paying us, stopped using our support, or disagreed with these Terms.
Our support obligations may be terminated by either of us at any time. Sections 5, 9, 10, and 11 survive.
13. Changes to these Terms
We may revise these supplemental Terms; revisions cannot retroactively narrow GPL rights in copies already distributed. Material revisions will update the effective date above and be published at the Terms of Service URL on our listing.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws rules.
